These Terms and Conditions apply to all purchases made through Crystal Sky at wearcrystalsky.com.
Crystal Sky creates sculptural 3D-printed jewelry and wearable objects incorporating natural gemstone spheres. Each item is made or finished with care in Vienna, Austria.

Crystal Sky is operated as a small business under the Austrian small business VAT exemption. No VAT is charged and no VAT is shown pursuant to § 6 Abs. 1 Z 27 UStG.

2. Scope
These Terms and Conditions apply to all orders placed through our online shop.
A customer is any person who places an order through the online shop. Where mandatory consumer protection laws apply, nothing in these Terms limits the customer’s statutory rights.
If you are buying as a consumer, you have the mandatory rights granted to consumers under Austrian law, EU law, and, where applicable, the mandatory consumer protection laws of your country of residence.
3. Contract language
The contract language for orders placed through the English-language website is English.
German may also be used. Customer service is available in English; German-language requests will also be handled where possible or legally required.
4. Products
Crystal Sky products are handmade, hand-finished, or produced in small batches.
Small variations in color, texture, gemstone pattern, surface finish, size, and 3D-printed structure are part of the character of the product and do not normally constitute defects.
Natural gemstones vary from piece to piece. Product photos are representative, but the exact color, pattern, transparency, inclusions, and surface appearance of each gemstone may differ slightly.
3D-printed components may show minor layer lines or surface texture. These are part of the manufacturing process unless they materially affect the normal use, safety, or durability of the product.
5. Custom sizing and made-to-order products
Many Crystal Sky bracelets are made to fit the wrist measurement selected or provided by the customer.
Products made to an individual wrist measurement, custom size, custom color combination, custom engraving, or another personal customer specification are made specifically for that customer.
For goods made to customer specifications or clearly personalized, the statutory right of withdrawal or cancellation may be excluded. More information is provided in our Returns & Withdrawal/Cancellation Policy.
Please measure carefully before ordering a custom-sized bracelet.
6. Ordering process and conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer. It is an invitation to the customer to place an order.
The customer can select products, choose available options, enter personal details, review the order, and correct input errors before submitting the order.
By clicking the final order button, the customer submits a binding offer to purchase the selected product.
An automatic confirmation of receipt of the order only confirms that the order has been received, unless expressly stated otherwise.
A contract is concluded when we expressly accept the order, confirm production, send a shipping confirmation, or dispatch the product.
We reserve the right to refuse an order where legally permitted, for example if a product is unavailable, payment fails, order information is incorrect, or there has been an obvious pricing, input, or technical error.
7. Order button
For a paid order, the final checkout button must clearly indicate that the customer is placing an order with an obligation to pay.
Depending on the checkout language, this may be shown as: “Order with obligation to pay”, “Place order with obligation to pay”, “Buy now”, “Pay now”, “Zahlungspflichtig bestellen”, or a similarly clear wording.
8. Prices, taxes, and payment
All prices are shown in euros.
Due to the Austrian small business VAT exemption, no VAT is charged and no VAT is shown pursuant to § 6 Abs. 1 Z 27 UStG.
Invoices may include the following wording:
“Umsatzsteuerbefreit – Kleinunternehmer gem. § 6 Abs. 1 Z 27 UStG.”
Shipping costs, if any, are shown separately before checkout.
Accepted payment methods are shown during checkout.
Payment is due at the time of order unless otherwise agreed.
For made-to-order or custom-made products, production may begin only after payment has been received.
9. Delivery and shipping
Delivery is made to the shipping address provided by the customer.
Estimated production and delivery times are shown on the product page, during checkout, or in the order confirmation.
Delivery times are estimates unless expressly confirmed as binding.
If a product is made to order, production time is additional to shipping time.
The customer is responsible for providing a complete and correct shipping address. Additional costs caused by incorrect or incomplete address information may be charged to the customer where legally permitted.
If delivery is delayed, we will inform the customer as soon as reasonably possible.
10. International orders, customs, and import charges
For deliveries outside Austria, additional import duties, customs duties, taxes, handling fees, or local charges may apply depending on the destination country.
For deliveries within the EU, customs duties generally do not apply. For deliveries to Switzerland and other countries outside the EU, customs duties and import charges may apply.
These charges are not controlled by Crystal Sky and are the responsibility of the customer unless otherwise stated during checkout.
Customers are responsible for checking whether the product can be imported into their country.
11. Retention of title
The product remains the property of the seller until full payment has been received.
12. Returns, withdrawal/cancellation, and refunds
Information about returns, statutory withdrawal or cancellation rights, voluntary returns, exchanges, refunds, and custom-made products is provided in our Returns & Withdrawal/Cancellation Policy.
For non-custom products, Crystal Sky may offer a voluntary return period that goes beyond the statutory minimum. The exact terms are stated in the Returns & Withdrawal/Cancellation Policy.
For goods made to customer specifications or clearly personalized, the statutory right of withdrawal or cancellation may be excluded.
This does not affect statutory warranty rights if a product is defective, damaged, or not what was ordered.

13. Online withdrawal/cancellation function
Where required by applicable law, Crystal Sky will provide an easily accessible online withdrawal or cancellation function for eligible consumer distance contracts.
This function is an additional way to exercise the statutory right of withdrawal or cancellation. It does not replace the customer’s ability to withdraw or cancel by another clear statement, such as email, where legally permitted.
14. Statutory warranty
Customers have statutory warranty rights under the applicable legal provisions.
If a product is defective, the customer may be entitled to repair, replacement, price reduction, or cancellation of the contract in accordance with applicable law.
Natural gemstone variation, normal handmade variation, minor 3D-printing texture, and ordinary signs of use are not defects unless the product does not correspond to what was agreed or reasonably expected.
Damage caused by improper use, accidents, strong impact, excessive force, heat, prolonged water exposure, harsh chemicals, modification of the product, or normal wear is not covered by statutory warranty unless mandatory law provides otherwise.
Any voluntary guarantee, if offered, is separate from statutory warranty rights and will be described separately.
15. Product care and safe use
Crystal Sky jewelry should be handled with care.
Unless otherwise stated, products should be kept away from excessive heat, strong impact, harsh chemicals, prolonged water exposure, and situations where the jewelry may be pulled, crushed, or caught.
Do not wear the product during sports, swimming, showering, sleeping, or activities where it may be exposed to excessive force.
Products are not toys and are not intended for children.
Small parts and gemstone spheres may present a choking hazard if a product is broken or misused.

16. Product photos and descriptions
We make reasonable efforts to display products accurately.
Colors may appear differently depending on screen settings, lighting, camera settings, and device display.
Measurements are approximate unless expressly stated otherwise.
Product descriptions, photos, and care information are intended to help customers make an informed purchase decision.
17. Customer responsibilities
The customer is responsible for providing accurate order information, including name, email address, billing address, shipping address, and wrist measurement where applicable.
For custom-sized bracelets, the customer is responsible for measuring their wrist correctly according to the sizing instructions provided.
If the customer provides an incorrect measurement, the product is not defective simply because the selected or provided measurement does not fit as expected.
Where possible, Crystal Sky may offer an adjustment, remake, or exchange solution at its discretion.
18. Intellectual property
All designs, product concepts, photos, text, logos, graphics, product names, product descriptions, and visual materials on wearcrystalsky.com are owned by Crystal Sky or used with permission.
They may not be copied, reproduced, modified, distributed, or used commercially without prior written consent.
Purchasing a product does not transfer any intellectual property rights in the design.
19. Vouchers, discounts, and promotions
Discounts, vouchers, and promotional offers are valid only under the conditions stated for the specific offer.
They cannot be exchanged for cash unless required by law.
Only one discount may be used per order unless otherwise stated.
A discount does not reduce or remove statutory consumer rights.
Where a price reduction is advertised, the reference price is the lowest price charged for the same product in the same sales channel during the preceding 30 days, unless a legal exception applies.
If a product has been available for less than 30 days, the reference price is the lowest price charged during the period in which the product was available in the same sales channel, unless a legal exception applies.
20. Gift cards
If gift cards are offered, the terms shown at the time of purchase apply.
Gift cards cannot be exchanged for cash unless required by law.
Gift cards should be treated like cash. Crystal Sky is not responsible for lost, stolen, or misused gift card codes unless mandatory law provides otherwise.
If a gift card has an expiry date, that expiry date will be clearly stated before purchase. Any expiry period must be reasonable and legally permissible.
Unless a shorter, legally valid expiry period is clearly stated, gift cards remain valid in accordance with the applicable statutory rules.
21. Digital products and downloads
The current Crystal Sky shop is intended primarily for physical products.
If Crystal Sky offers digital products, digital content, downloads, design files, STL files, software, online services, or other digital goods in the future, additional terms may apply.
Any specific conditions for digital products, including access, delivery, usage rights, technical requirements, withdrawal or cancellation rights, and statutory rights for digital content or digital services, will be provided before purchase.
Purchasing a digital product does not transfer ownership of the underlying intellectual property unless expressly stated.
22. Liability
Crystal Sky is liable in accordance with applicable law.
Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, or mandatory statutory consumer rights.
For slight negligence, liability may be limited only where legally permitted.
Crystal Sky is not liable for damage caused by improper use, failure to follow care instructions, unauthorized modification, or use of the product for purposes for which it was not intended, unless mandatory law provides otherwise.
23. Data protection
Personal data is processed in accordance with our Privacy Policy.
The Privacy Policy explains how we collect, use, store, and protect customer data.
Personal data is processed on the legal bases set out in the Privacy Policy and in accordance with the GDPR / DSGVO.
24. Alternative dispute resolution
We aim to resolve customer concerns directly and fairly.

We are willing to participate in alternative dispute resolution proceedings before a competent, officially recognized consumer arbitration body, where such a body has jurisdiction.

25. Applicable law
Austrian law applies.
For consumers, this choice of law does not deprive them of mandatory consumer protection rights that apply in their country of residence.
26. Place of jurisdiction
For consumers, the statutory rules on jurisdiction apply.
For business customers, where legally permitted, the competent court at the seller’s registered place of business applies.
27. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain valid.
The invalid or unenforceable provision will be replaced by the applicable statutory rule.
28. Changes to these Terms
We may update these Terms from time to time.
The version available at the time of the customer’s order applies to that order.
